A unique part of the real estate business is Receivership, or the management of a property or business that is entrenched in a legal process such as foreclosure, probate or bankruptcy.

When a property enters the foreclosure process, the courts may appoint an independent third party as trustee of the asset. While the building is in receivership, it is this third party entity’s responsibility to secure the property, assess the condition of the building, recommend and perform all necessary repairs and ready the asset for a prompt sale.

In cases of properties with existing tenants, such as strip malls, apartments or even rental houses, it is imperative for the Receiver to establishment management of the entity. The goal is to continue to receive cash flow from tenants while the asset makes its way through the court process.
